Debtors
(If you owe money to another, you are a debtor)

  Being sued over a debt ? 
  • Don't ignore the suit!  Talk to an attorney!  Your creditors only have a certain period of time in which to sue you.  Sometimes they wait too long but file suit anyways!  If you have a knowledgeable attorney on your side this can be a great situation for you!  Even if the suit is filed on time you may still have options! You will never know if you if ignore the lawsuit.
  Are you being sued by a collection company and not the company you actually owe? 
  • This is related to the first point.  If you are being sued by "Big Bad Collections Inc." over money you owe a credit card company (instead of being sued by the company you owe) in some cases you may not have to pay the debt.  But you will never know if we don't talk!
  Debtors have rights, too!
  • Even if you owe the money you still have rights!  But the courts won't consider those rights if you don't answer the lawsuit and defend yourself.

  Does someone owe you money and they refuse to pay? 
  • Stop hoping they will pay!  File suit and get a judgment - it's good for ten years.  A lot can happen in ten years! 
  Do you have a judgment against someone and need help collecting? 
  • There are steps you can take to collect what's owed to you! 
  • If that person is a Michigan resident you can garnish their wages, their bank accounts and even their state income tax refund.  It may not be much but it's better than nothing.  If they own real estate, you can file a judgment lien against the real estate. Sometimes simply taking these actions is enough incentive to compel payment of the debt.
